Nadużycia prawa dyplomatycznego: przestępczość i przemyt dóbr kultury

Niniejsza praca licencjacka poświęcona jest nadużyciom przywilejów i immunitetów dyplomatycznych, analizowanym z perspektywy prawnej, społecznej i kulturowej. Punktem wyjścia jest omówienie instytucji immunitetu dyplomatycznego na podstawie Konwencji wiedeńskiej o stosunkach dyplomatycznych z 1961 r., która stanowi główny akt prawa międzynarodowego regulujący tę materię. Celem pracy jest przeanalizowanie przypadków przestępstw związanych z nadużyciem statusu dyplomatycznego z uwzględnieniem reakcji mediów, społeczeństwa oraz państw i sądownictwa. W pracy wyodrębniono przemyt dóbr kultury jako szczególną formę nadużycia immunitetów dyplomatycznych ze względu na nieodwracalny charakter strat kulturowych oraz rozbudowany system ich ochrony prawnej. Ostatni rozdział poświęcony jest obecnie funkcjonującym mechanizmom przeciwdziałania nadużyciom prawa dyplomatycznego, a także różnorodnym propozycjom reformy systemu. Wyjaśniono również, dlaczego postulowane zmiany nie zostały dotychczas wprowadzone, ukazując sprzeczne stanowiska państw oraz praktyczne trudności we wdrożeniu tych mechanizmów.

This bachelor's thesis focuses on the abuse of diplomatic privileges and immunities, examined from legal, social, and cultural perspectives. The starting point of the thesis is the institution of diplomatic immunity based on the Vienna Convention on Diplomatic Relations of 1961, which constitutes the principal international legal instrument governing this matter. The aim of the thesis is to analyse cases of crimes related to the abuse of diplomatic status, taking into account the reactions of the media, society, states, and the judiciary. The thesis identifies the smuggling of cultural property as a particular form of abuse of diplomatic immunity, due to the irreversible nature of cultural losses and the extensive system of their legal protection. The final chapter is dedicated to the mechanisms currently in place to counteract abuses of diplomatic law, as well as to various proposals for reforming the system. The thesis also explains why the proposed changes have not yet been implemented, presenting the conflicting positions of states and the practical difficulties in implementing these mechanisms.
