Koncepcja własności warstwowej oraz perspektywa jej prowadzenia do polskiego porządku prawnego

Przedmiotem pracy magisterskiej jest konstrukcja prawna własności warstwowej oraz analiza możliwości jej wprowadzenia do polskiego porządku prawnego. W ramach opracowania przedstawiono badania prawnoporównawcze modeli własności warstwowej obowiązujących w wybranych zagranicznych systemach prawnych oraz formalnoprawną analizę polskich przepisów dotyczących instytucji prawa cywilnego zawierających elementy własności warstwowej, a więc przede wszystkim przepisów ustawy o własności lokali oraz kodeksu cywilnego o służebności przesyłu.

Praca nie wyczerpuje rozległej tematyki własności warstwowej. Jest ona przeglądem ogólnych uwarunkowań tej instytucji, której celem jest rozważanie, czy obowiązujące instytucje prawa cywilnego mogą - po ewentualnych zmianach legislacyjnych - spełniać funkcję własności warstwowej, a także, czy wprowadzenie własności warstwowej jako odrębnej instytucji prawa rzeczowego jest wskazane.

The subject of this master’s thesis is the concept of three-dimensional property and an analysis of the feasibility of introducing it into the Polish legal system. The thesis presents comparative legal research on models of three-dimensional property in selected foreign legal systems, as well as a doctrinal analysis of Polish provisions concerning civil law institutions contaning elements of three-dimensional property, in particular the provisions of the act on the ownership of premises and the Civil Code on the transmission easement.

This master’s thesis does not exhaustively cover the extensive subject matter of three-dimensional property. It provides an overview of the general conditions governing this institution, the aim of wich is to consider whether the existing institutions of civil law could - following possible legislative amendments - fulfill the function of three-dimensional property, and whether the introduction of three-dimensional property as a separate institution of property law is advisable.
