Zintegrowany plan inwestycyjny. Analiza i ocena regulacji w kontekście systemu planowania przestrzennego w Polsce

Niniejsza praca stanowi próbę opisu najważniejszych zagadnień prawnych związanych z wprowadzeniem do porządku prawnego instytucji zintegrowanych planów inwestycyjnych. Dokonano w niej analizy prawnej przepisów ustawy o planowaniu i zagospodarowaniu przestrzennym regulujących postępowanie w przedmiocie uchwalenia zintegrowanego planu inwestycyjnego jako szczególnej formy miejscowego planu zagospodarowania przestrzennego, podjętej w kontekście systemu aktów planowania przestrzennego w polskim porządku prawnym, w tym zwłaszcza podobnych do omawianej instytucji instrumentów, czyli uchwały o ustaleniu lokalizacji inwestycji mieszkaniowej oraz umowy urbanistycznej zawieranej w postępowaniu o uchwalenie miejscowego planu rewitalizacji. Szczególną uwagę poświęcono instytucji umowy urbanistycznej, badając charakter prawny tego nowatorskiego instrumentu oraz jego zasadnicze elementy konstrukcyjne. W pracy zawarto również ocenę uregulowania zintegrowanych planów inwestycyjnych, dokonaną w kontekście założeń sformułowanych w uzasadnieniu ustawy nowelizującej ustawę o planowaniu i zagospodarowaniu przestrzennym, Krajowego Planu Odbudowy, wyników analizy porównawczej z instytucjami podobnymi oraz wypowiedzi komentatorów.

This work is an attempt to describe the most important legal aspects related to the introduction of the institution of integrated investment plans to the legal system. It analyses the legal provisions of the Act on spatial planning and development regulating the proceedings on the adoption of an integrated investment plan as a specific form of a local spatial development plan, in the context of the system of spatial planning acts in the Polish legal system, including in particular instruments similar to the institution in question, i.e. the resolution on determining the location of a housing investment and the urban planning agreement concluded in the proceedings on the adoption of a local revitalisation plan. Particular attention was paid to the institution of the urban contract, examining the legal nature of this innovative instrument and its essential structural elements. The study also includes an assessment of the regulation of integrated investment plans, made in the context of the assumptions formulated in the justification of the Act amending the Act on spatial planning and development, the National Recovery and Resilience Plan, the results of a comparative analysis with similar institutions and the statements of commentators.
