Zatrudnienie organów państwa. Stosunek pracy Prezesa Najwyższej Izby Kontroli jako przykład zatrudnienia piastuna organu państwa

Praca porusza temat zatrudnienia w sferze publicznej, w szczególności zatrudnienie osób pełniących funkcje organów państwa. Praca składa się z dziesięciu rozdziałów. W rozdziale pierwszym sformułowana została definicja organu państwa na cele rozważań pracy. W kolejnych rozdziałach omówione zostały różne podstawy zatrudnienia organów państwa: zatrudnienie ustrojowoprawne, zatrudnienie administracyjnoprawne oraz stosunki pracy. W rozdziale dziewiątym przedstawiono ramy prawne oraz podstawowe zadania Najwyższej Izby Kontroli. W rozdziale dziesiątym omówiono szczegółowo stosunek pracy na podstawie powołania Prezesa Najwyższej Izby Kontroli, z uwzględnieniem odstępstw od norm zawartych w przepisach Kodeksu Pracy. W zakończeniu dokonano podsumowania rozważań oraz wskazano potencjalne kierunki zmian w ustawodawstwie. W pracy zastosowano metodę: dogmatyczno-prawną, historyczno-prawną, porównawczo-prawną oraz językowo-prawną.

The thesis addresses the topic of employment in the public sector, with particular focus on the employment of individuals holding positions as state organs. The thesis consists of ten chapters. In the first chapter, a definition of a state organ is formulated for the purposes of the analysis. The subsequent chapters discuss various legal bases for the employment of state organs: constitutional and legal employment, administrative and legal employment, as well as employment relationships under labor law. Chapter nine presents the legal framework and fundamental tasks of the Supreme Audit Office. Chapter ten provides a detailed discussion of the employment relationship based on the appointment of the President of the Supreme Audit Office, taking into account specific provisions differing from those contained in the Labour Code. The conclusions summarize the considerations and indicate potential directions for legislative changes. The thesis employs the following research methods: dogmatic-legal, historical-legal, comparative-legal, and linguistic-legal.
