Postępowanie administracyjne w sprawie o wywłaszczenie nieruchomości

Niniejsza praca podejmuje temat postępowania administracyjnego w sprawie o wy-właszczenie nieruchomości. Instytucja wywłaszczenia ma szczególny charakter i umiejscowienie w systemie prawa, bowiem zezwala na władczą ingerencję Państwa w konstytucyjnie chronione prawa jednostki, prawo własności i prawa rzeczowe do nie-ruchomości. W pierwszej części praca prezentuje rys historyczny, genezę kształtowania się instytu-cji wywłaszczenia w historii prawa na świecie i w Polsce, pojęcie wywłaszczenia i cele uzasadniające wywłaszczenie nieruchomości. W części głównej przedstawiony jest przebieg postępowania w sprawie o wywłaszczenie, przesłanki i tryb jego wszczęcia, szczegółowe elementy wniosku o wszczęcia postępowania wywłaszczeniowego i opis decyzji administracyjnej, kończącej postępowanie w tej sprawie, a także obowiązki związane z wywłaszczeniem – wypłata odszkodowania na rzecz wywłaszczanego oraz ewentualny zwrot wywłaszczonej nieruchomości.

This work addresses the subject of administrative proceedings in a case of expropriation of real estate. The institution of expropriation has a special nature and location in the legal system, because it allows for the authoritative interference of the State in the constitutionally protected rights of the individual, the right of ownership and property rights to real estate.

In the first part, the work presents a historical outline, the genesis of the formation of the institution of expropriation in the history of law in the world and in Poland, the concept of expropriation and the goals justifying the expropriation of real estate. The main part presents the course of the proceedings in a case of expropriation, the premises and procedure for its initiation, detailed elements of the application to initiate expropriation proceedings and a description of the administrative decision ending the proceedings in this case, as well as the obligations related to expropriation - payment of compensation to the expropriated person and the possible return of the expropriated real estate.
