Obowiązki informacyjne dewelopera przed zawarciem umowy deweloperskiej

W ustawie deweloperskiej z 2021 r., w porównaniu do ustawy z 2011 r., zwiększono i doprecyzowano zakres informacji przedkontraktowych określonych w standardowym formularzu informacyjnym stanowiącym załącznik do ustawy. Z uwagi na szerszy zakres obecnie obowiązującej ustawy, informacje przedkontraktowe dotyczą większego katalogu umów. Głównym narzędziem informacyjnym jest standardowy formularz informacyjny, ale przewidziano również inne metody informowania (informacja w lokalu przedsiębiorstwa, "mini" standardowy formularz informacyjny). Doświadczenia wynikające z poprzedniej ustawy deweloperskiej oraz analizy najlepszych wzorców legislacyjnych unijnego i polskiego prawa konsumenckiego nie zostały jednak w pełni wykorzystane. Nie określono np. charakteru prawnego standardowego formularza informacyjnego, w szczególności w odniesieniu do oferty i umowy; nie wprowadzono wymogów, aby informacja była jasna i zrozumiała od początku, a nie dopiero w momencie jej zmiany; nie zagwarantowano kupującemu wystarczającego czasu na zapoznanie się ze standardową informacją.

In the Developer Act of 2021, compared to the Act of 2011, the scope of pre-contractual information specified in the standard information form constituting an appendix to the Act was increased and clarified. Due to the broader scope of the current act, the pre-contractual information concerns a larger catalogue of contracts. The main information tool is the standard information form, but other methods of informing are also provided (informationa at the business premises, "mini" standard form information). However, the experience resulting from the previous developer act and the analysis of the best legislative models of EU and Polish consumer law have not been fully used. For exemple, the legal nature of the standard information form, in particular in relation to the offer and the contract, was not determined; no requirements were introduced for the information to become clear and understandable from the beginning and not only at the moment of its changes; the buyer is not guaranteed sufficient time to familiarize himself with the standard information provided.
