Międzynarodowe prawo surowców naturalnych

Praca magisterska koncentruje się na istocie międzynarodowego Prawa w zakresie surowców naturalnych w szczególności mineralnych I energetycznych. We wstępie zostały poruszone kwestie istoty: surowców naturalnych, prawa oraz prawa międzzynarodowego. Ponadto znalazł się rys historyczny jak prawo I surowce kształtowały naszą cywilizacje od jej początku. Ponadto zostały wymienione podstawowe funkcje surowców I prawa międzynarodowego. Celem Pracy jest wykazanie jak ważne surowce naturalne są w krztałtowaniu światowego ładu oraz relacji między państwami I wykazać potrzebe większej regulacji na szczeblu międzynarodowym kwestii związanych z surowcami naturalnymi. Ważnym jest podkreślenie że zarówno surowcw naturalne jak I prawo międzynarodowe krztałtują relacjie między państwami oraz sytuacje geopolityczną. W pierwszej kolejności została omówiona podstawowa zasada rządząca międzynarodowym prawem surowców naturalnych która bezpośrednio wywodzi się z podstawowej zasady prawa międzynarodowego z systemu Karty ONZ. Chodzi o zasadę stałej suwerenności nad zasobami naturalnymi która wywodzi się od zasady suwerennej równości państw. Następnie został omówiony reżim zasobów naturalnych na wodach międzynarodowych oraz kwestie do którego momentu państwa mają suwerenność nad zasobami morskimi a od którego momentu surowcw zaczynają stanowić wspólne dziedzictwo lidzkości. W tym rozdziale zostało omówiony system eksploatacji surowców naturalnych. Ważną role odgrywają normy ochrony środowiska, którymi trzeba się kierować w “obszarze”. Następnie został omówiony reżim arktyki I antarktyki dotyczący roszczeń terutorialnych/ reżimu eksploatacji surowców oraz napięć międzynarodowych jaakie dotyczą surowców na biegunach. Ważną kwestią dla europejskiej części świata jest prawo I strategia unii europejskiej w aspekcie surowcow krytycznych I strateggicznych. W pracy jest omówiona polityka I strategia z CRMA. Kulminacyjnym punktem tej pracy jest omówienie prawa konfliktów zbrojnych o surowcw naturalne oraz wspołczesnych konfliktów toczących się surowce krytyczne I energetyczne. Są też konflikty gdzie surowce odgrywają role pośrednią ale niezaprzeczalną. Bardzo istotnym surowcem energetycznym który przez dekady krztałtuje relacje międzynarodową jest ropa. Rola ropy oraz ramy prawne kluczowej organizacji jaką jest OPEC w ksztaltowanie stosunków międzynarodowych oraz wykonywanie innych międzynarodowych traktatowych zobowiązań również zostały omówione. Praca pokazuje korelację między surowcami a ochroną środowiska, między innymi pokazuje role surowców realizacji zobowiązań klimatycznych. Można zaobserwować pewien paradoks czytając pracę. Praca zwraca uwagę na korelacje między surowcami a środowiskiem a w szczegolnosci międzynarodowymi zobowiązaniami środowiskowymi i klimatycznymi. Praca wykazuję jak obszerną kwestią w prawie międzynarodowym jest kwestia surowców naturalnych a w szczegolności surowców energetycznych i krytycznych.

The master’s thesis focuses on the essence of international law concerning natural resources, in particular mineral and energy resources. The introduction addresses the essence of natural resources, law, and international law. It also includes a historical overview of how law and natural resources have shaped our civilization from its beginnings. In addition, the basic functions of natural resources and international law are presented. The aim of the thesis is to demonstrate how important natural resources are in shaping the world order and relations between states, as well as to show the need for greater regulation of issues related to natural resources at the international level. It is important to emphasize that both natural resources and international law shape relations between states and the geopolitical situation. First, the thesis discusses the fundamental principle governing international law on natural resources, which derives directly from a basic principle of international law under the system of the UN Charter. This is the principle of permanent sovereignty over natural resources, which derives from the principle of the sovereign equality of states. Next, the regime of natural resources in international waters is discussed, including the question of up to what point states exercise sovereignty over marine resources and from what point such resources begin to constitute the common heritage of humankind. This chapter also discusses the system of exploitation of natural resources. Environmental protection norms, which must be followed in the “Area”, play an important role. The thesis then examines the legal regimes of the Arctic and Antarctica concerning territorial claims, the regime for the exploitation of natural resources, and international tensions relating to resources in the polar regions. An important issue for the European part of the world is the law and strategy of the European Union concerning critical and strategic raw materials. The thesis discusses the policy and strategy set out in the CRMA. The culminating point of the thesis is the discussion of the law of armed conflicts over natural resources and contemporary conflicts concerning critical and energy resources. There are also conflicts in which natural resources play an indirect but undeniable role. Oil is a very significant energy resource that has shaped international relations for decades. The role of oil and the legal framework of a key organization, OPEC, in shaping international relations and fulfilling other international treaty obligations are also discussed. The thesis shows the correlation between natural resources and environmental protection, including the role of resources in implementing climate obligations. A certain paradox can be observed reading this thesis. The thesis points to the correlation between natural resources and the environment, especially international environmental and climate obligations.The thesis demonstrates how broad the issue of natural resources is in international law, particularly with regard to energy resources and critical raw materials.
