Cyberbezpieczeństwo w sektorze finansowym w kontekście polskich i unijnych regulacji.

Abstrakt (PL)

Celem niniejszej pracy magisterskiej jest analiza krajowych i europejskich regulacji prawnych dotyczących cyberbezpieczeństwa w sektorze finansowym. Struktura pracy przeprowadza czytelnika od ogólnych zagadnień teoretycznych i technicznych do szczegółowej analizy przepisów prawa. Rozdział pierwszy definiuje kluczowe terminy z zakresu cyberbezpieczeństwa i sektora finansowego oraz systematyzuje rodzaje ataków, mechanizmy ochrony przed zagrożeniami i pojęcie infrastruktury teleinformatycznej. Rozdział drugi koncentruje się na rekonstrukcji europejskiego krajobrazu regulacyjnego, ze wskazaniem na fundamentalne przepisy dyrektywy NIS2, rewolucyjne regulacje rozporządzenia DORA oraz konkretne wymogi sektorowe dyrektywy PSD2 i PSD3. Rozdział trzeci nakreśla krajowe ramy prawne, dokonując szczegółowej analizy ustawy o krajowym systemie cyberbezpieczeństwa, kompetencji organu nadzorczego, jakim jest dla sektora finansowego Komisja Nadzoru Finansowego, operacyjnego znaczenia zespołów CSIRT oraz specyficznych wymogów regulacyjnych dotyczących sektora bankowego i usług płatniczych. Rozdział czwarty dedykowany jest analizie odpowiedzialności administracyjnej, cywilnoprawnej oraz karnej, stanowiących odpowiedź ustawodawcy na naruszenia w zakresie cyberbezpieczeństwa.

Abstrakt (EN)

The aim of this master’s thesis is to analyze national and European legal regulations concerning cybersecurity in the financial sector. The structure of the thesis guides the reader from general theoretical and technical issues to a detailed legal analysis. The first chapter defines key concepts in the field of cybersecurity and the financial sector, and systematizes types of attacks, mechanisms for protection against threats, and the concept of telecommunication and information infrastructure. The second chapter focuses on the reconstruction of the European regulatory landscape, highlighting the fundamental provisions of the NIS2 Directive, the groundbreaking regulations of the DORA Regulation, as well as the specific sectoral requirements of the PSD2 and PSD3 Directives. The third chapter outlines the national legal framework, providing a detailed analysis of the Act on the National Cybersecurity System, the competencies of the supervisory authority, which in the financial sector is the Polish Financial Supervision Authority (KNF), the operational significance of CSIRT teams, and the specific regulatory requirements concerning the banking and payment services sector. The fourth chapter is devoted to the analysis of administrative, civil, and criminal liability, which constitute the legislator’s response to cybersecurity breaches.
