Abstrakt (PL)
Celem pracy jest poddanie analizie zagadnienia dopuszczalności skargi o stwierdzenie niezgodności z prawem prawomocnego orzeczenia w procesie cywilnym. Scharakteryzowane zostały geneza skargi oraz jej ewolucja. Opisany został charakter skargi jako komplementarnego ze skargą kasacyjną nadzwyczajnego środka prawnego, zmierzającego do wzruszenia prawomocnego orzeczenia nie przez jego zmianę bądź uchylenie – a przez uzyskanie prejudykatu. Poruszona została problematyka klasyfikacji przesłanek dopuszczalności środków zaskarżenia. Zaprezentowany został katalog przesłanek dopuszczalności skargi. Scharakteryzowano przesłanki przedmiotowe, jaki i podmiotowe dopuszczalności skargi oraz przytoczono wypowiedzi doktryny, jak i judykatury poświęcone omawianej problematyce. Wskazane zostały podnoszone na przestrzeni lat wątpliwości interpretacyjne względem poszczególnych przepisów. Wymienione i objaśnione zostały wymagania konstrukcyjne skargi. Zwięzłemu omówieniu poddana została kwestia terminu, w jakim dopuszczalne jest złożenie skargi oraz braku możliwości jego przywrócenia.

The aim of this work is to analyze the admissibility of a complaint for declaring a final judgment contrary to law in civil process. The genesis of the complaint and its evolution are outlined. The nature of the complaint as a complementary extraordinary legal remedy to the cassation appeal is described, aiming to overturn a final judgment not by amending or setting aside it, but by obtaining a preliminary ruling. The classification of the conditions for the admissibility of appeals is discussed. A catalog of the conditions for the admissibility of a complaint is presented. The objective and subjective conditions for the admissibility of a complaint are characterized, and legal and jurisprudential pronouncements on the subject are cited. Interpretative doubts raised over the years regarding individual provisions are identified. The structural requirements of the complaint are listed and explained. The time limit for filing a complaint and the impossibility of reinstating it are briefly discussed.
