Zakaz małżeński choroby psychicznej albo niedorozwoju umysłowego – jego istota, funkcje i aktualność

Tematem pracy jest instytucja zakazu małżeńskiego choroby psychicznej albo niedorozwoju umysłowego. Omówiono historię zakazu, jego zakres, relację zakazu do ubezwłasnowolnienia, kompetencje kierownika USC w zakresie oceny występowania zakazu, udzielenie przez sąd zezwolenia na zawarcie małżeństwa oraz unieważnienie małżeństwa na podstawie przedmiotowego zakazu. Przedstawiono zagadnienie zgodności art. 12 k.r.o. z Konstytucją Rzeczypospolitej Polskiej oraz z Konwencją o prawach osób niepełnosprawnych sporządzoną w Nowym Jorku 13 grudnia 2006 r. W opracowaniu przedstawiono także funkcje przedmiotowego zakazu i oceniono ich aktualność. Omówiono również potrzebę zmiany zakazu albo jego uchylenia.

The topic of the thesis is the institution of the matrimonial impediment resulting from mental illness or mental retardation. The history of the matrimonial impediment, its scope, the relation of the matrimonial impediment to incapacitation, the competence of the Head of the Civil Registry Office in assessing the presence of the matrimonial impediment, the court's granting of permission to enter into marriage and the annulment of marriage on the basis of the matrimonial impediment in question are discussed. The issue of the conformity of Article 12 of the The Family and Guardianship Code with the Constitution of the Republic of Poland and the Convention On The Rights Of Persons With Disabilities adopted on 13 December 2006 at the United Nations Headquarters in New York was presented. The thesis also presents the functions of the matrimonial impediment in question and assesses their relevance. It also discusses the need to amend the matrimonial impediment or to repeal it.
