Wywłaszczenie nieruchomości pod inwestycje infrastrukturalne w polskim systemie prawnym

Niniejsza praca magisterska opisuje rozwiązania prawne wywłaszczeń nieruchomości stosowanych na potrzeby pozyskania gruntów, niezbędnych do realizacji inwestycji publicznych rozwijających infrastrukturę. W pracy zakreślone zostały także aspekty historyczne, wraz z przykładami ich implementacji w obecnym systemie prawnym, oraz porównanie zasadności ich stosowania w przeszłości i dzisiaj. Zawartość pracy obejmuje też możliwości nabycia nieruchomości w drodze cywilnoprawnej. Częścią zasadniczą jest jednak wyszczególnienie i opisanie kilku wybranych podstaw prawnych regulujących kwestię wywłaszczeń. Opis ten wraz z analizą poszczególnych przepisów wyjaśnia konieczność tworzenia i stosowania w tym procesie ustaw szczególnych. Praca zawiera opis procedury wywłaszczeń opisanej w rozdziałach czwartym, piątym i szóstym ustawy o gospodarce nieruchomościami. W stosunku do niej uwzględnione zostały ułatwienia zawarte w ustawach szczególnych, dotyczących poszczególnych inwestycji. Praca zawiera także porównanie praw i obowiązków wywłaszczanych i wywłaszczających, na podstawie poszczególnych aktów prawnych, a także różnice w procedurze, zarówno przeprowadzenia wywłaszczenia, jak i procedurze odszkodowawczej. Podsumowanie zawiera wyniki analizy przepisów, wraz z kilkoma propozycjami zmian, które powinny być przeprowadzone, by usprawnić procesy wywłaszczeń.

This master's thesis describes the legal solutions for expropriation of real estate used for the purpose of acquiring land, necessary for the implementation of public investments developing infrastructure. The work also outlines historical aspects, along with examples of their implementation in the current legal system, and a comparison of the justification for their use in the past and today. The content of the work also includes the possibilities of acquiring real estate through civil law. However, the main part is the specification and description of several selected legal bases regulating the issue of expropriation. This description, together with the analysis of individual provisions, explains the need to create and apply special acts in this process. The work contains a description of the expropriation procedure described in chapters four, five and six of the Real Estate Management Act. In relation to it, the facilities included in special acts concerning individual investments have been taken into account. The work also contains a comparison of the rights and obligations of the expropriated and expropriating, based on individual legal acts, as well as differences in the procedure, both for carrying out expropriation and the compensation procedure. The summary contains the results of the analysis of the regulations, together with several proposals for changes that should be made to improve the expropriation processes.
