Nielegalne adopcje a handel dziećmi w świetle polskiego kodeksu karnego

Poniższa praca ,,Nielegalne adopcje a handel dziećmi w świetle polskiego kodeksu karnego’’, zajmuje się tematyką wieloaspektowości w zakresie możliwych form nielegalnego obrotu dziećmi. Przyjęto hipotezę badawczą uznającą, że: Powszechność zjawiska jakim jest posługiwanie się instytucją przysposobienia do nielegalnego obrotu dzieckiem wynika z różnorodności możliwych sposobów obejścia prawa. Problemem badawczym niniejszej pracy było pytanie: Jaki jest zakres możliwych sposobów obejścia prawa w zakresie nielegalnych form obrotu dzieckiem? Praca skupia się na analizie granicy między kryminalizacją handlu ludźmi a nielegalną adopcją. W tym celu omówiono i przedstawiono główne pojęcia i konstrukcje wskazanych zagadnień oraz przeanalizowano nowelizację kodeksu karnego poruszającą tematykę nielegalnego obrotu dziećmi. Praca została napisana głównie w oparciu o materiały źródłowe z literatury naukowej, orzecznictwa sądów oraz specjalistycznych czasopism. W ramach przeprowadzonej analizy okazało się, że w obecnym stanie prawnym nie nastąpiło precyzyjne uregulowanie i tym samym jednoznaczne rozstrzygnięcie jakie zachowania związane z przekazywaniem dzieci stanowią czyn przestępny. Taki stan rzeczy powoduje brak dostatecznej ochrony dzieci przed wszelkiego rodzaju komercyjnym wykorzystaniem i przedmiotowym traktowaniem.

The following work , Illegal adoptions and child trafficking in light of the Polish Criminal Code, deals with the subject of multifacetedness in terms of possible forms of illegal child trafficking. A research hypothesis was adopted recognizing that: The universality of the phenomenon of using the institution of adoption to illegally trade in children is due to the variety of possible ways of circumventing the law. The research problem of this study was the question: what is the range of possible ways of circumventing the law in terms of illegal forms of child trafficking? The work focuses on analyzing the boundary between the criminalization of trafficking and illegal adoption. To this end, the main concepts and constructs of the indicated issues were discussed and presented, and the amendments to the Criminal Code addressing the issue of illegal child trafficking were analyzed. The work was written mainly based on source materials from scientific literature, court decisions and specialized journals. As part of the analysis carried out, it turned out that in the current state of the law there has been no precise regulation and thus unambiguous resolution of what behavior related to the transfer of children constitutes a criminal act. This state of affairs results in insufficient protection of children from any kind of commercial exploitation and subjective treatment.
