Zastosowanie zasady podwójnego skutku do przypadków kraniotomii i histerektomii

Celem pracy jest (i) rekonstrukcja kluczowych stanowisk w sporze o zastosowanie zasady podwójnego skutku do przypadków histerektomii i kraniotomii, (ii) krytyka wybranych argumentów na rzecz istnienia moralnie istotnej różnicy w intencjach sprawców pomiędzy przypadkiem histerektomii a przypadkiem kraniotomii oraz (iii) próba ustalenia, które z konkurencyjnych ujęć intencji jest bardziej adekwatne w odczytywaniu i stosowaniu zasady podwójnego skutku. Rozdział pierwszy zawiera rekonstrukcję zasady podwójnego skutku. W rozdziale drugim omówione zostały najważniejsze interpretacje aplikacji zasady do przypadków histerektomii i kraniotomii (H.L.A. Hart, P. Foot, G.E.M. Anscombe, W.S. Quinn, T.A. Cavanaugh, J. Boyle). W rozdziale trzecim przeprowadzona została krytyczna analiza wybranych argumentów mających w przypadku kraniotomii przemawiać za przypisaniem sprawcy intencjonalnego spowodowania złego skutku (m.in. argumentów odwołujących się do odczytania tzw. pośredniości skutku działania w kategoriach prawdopodobieństwa oraz problemu bliskości). Rozdział czwarty poświęcony został omówieniu rozumienia pojęcia intencji obecnego w sformułowaniu zasady podwójnego skutku i krytyce tzw. „szerokiego” ujęcia intencji. Sformułowane zostały również argumenty na rzecz przyjęcia „wąskiego” ujęcia intencji w stosowaniu zasady podwójnego skutku.

The aim of this paper is to (i) reconstruct the key viewpoints in the dispute over the application of the doctrine of double effect to hysterectomy and craniotomy cases, (ii) critique some of the arguments for the existence of a morally significant difference in agents’ intentions between the hysterectomy case and the craniotomy case, and (iii) attempt to determine which of the competing accounts of intention is more adequate in understanding the doctrine of double effect. Chapter One provides a reconstruction of the doctrine of double effect. Chapter Two discusses the most important interpretations of the application of the doctrine to hysterectomy and craniotomy cases (H.L.A. Hart, P. Foot, G.E.M. Anscombe, W.S. Quinn, T.A. Cavanaugh, J. Boyle). Chapter Three analyzes some of the arguments intended to support the view that in the case of craniotomy, the agent intentionally brings about the bad side effect (such as the argument from closeness ). The last chapter discusses the main interpretations of the concept of intention (so-called thick and thin conceptions of intention) present in the formulation of the doctrine of double effect.
