W pierwszej części omówiono kluczowe koncepcje teoretyczne, w tym specyfikę języka prawnego, różnice między tłumaczeniem prawniczym a literackim oraz rolę ekwiwalencji funkcjonalnej w tłumaczeniu tekstów prawnych. Szczególną uwagę poświęcono terminologii, zwłaszcza wyzwaniom wynikającym z wielości systemów prawnych w Europie, w tym różnicom między systemami prawa anglosaskiego i kontynentalnego. W części analitycznej przeanalizowano techniki tłumaczeniowe, takie jak ekwiwalencja kulturowa i formalna, tłumaczenie deskryptywne oraz transkrypcja, które pomagają rozwiązać problemy terminologiczne. This thesis addresses the challenges and techniques of legal translation within the European Union, focusing specifically on documents for institutions like the Court of Justice of the European Union. The first part discusses key theoretical concepts, including the unique characteristics of legal language, differences between legal and literary translation, and the role of functional equivalence in translating legal texts. Special attention is given to terminology challenges, particularly those arising from the coexistence of different legal systems in Europe, such as the divergences between common law and civil law traditions. The analytical section examines translation techniques, such as cultural and formal equivalence, descriptive translation, and transcription, which are used to address terminological issues. The thesis concludes that employing appropriate translation techniques is crucial for maintaining precision and terminological consistency in EU legal documents.
