FIFA/UEFA pko. TSUE - Analiza wpływu orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej na rynek piłki nożnej

Praca analizuje wpływ orzecznictwa Trybunału Sprawiedliwości UE na rynek profesjonalnej piłki nożnej, badając konflikt między autonomicznym porządkiem prawnym FIFA i UEFA (lex sportiva) a fundamentalnymi zasadami prawa unijnego. Poprzez studium kluczowych wyroków, od sprawy Bosman po Superliga, praca wykazuje, jak TSUE systematycznie redefiniował granice autonomii sportu. Wnioski dowodzą, że Trybunał, podporządkowując regulacje sportowe zasadom rynku wewnętrznego i konkurencji, gdy te dotyczą działalności gospodarczej, zmusił federacje do implementacji zasad praworządności, proporcjonalności i transparentności.

The thesis analyzes the impact of the case law of the Court of Justice of the EU on the professional football market, examining the conflict between the autonomous legal order of FIFA and UEFA (lex sportiva) and the fundamental principles of European Union law. Through a study of key judgments, from the Bosman case to the Superliga case, the thesis demonstrates how the CJEU has systematically redefined the boundaries of the autonomy of sport. The conclusions prove that the Court, by subjecting sports regulations to the principles of the internal market and competition law when they concern economic activity, has forced the federations to implement the principles of the rule of law, proportionality, and transparency.
