Ochrona podstawowych wartości Unii Europejskiej a naruszenie zasady praworządności w Polsce i na Węgrzech

Celem pracy jest przedstawienie narzędzi oraz mechanizmów proceduralnych Unii Europejskiej stosowanych do ochrony podstawowych wartości zapisanych w traktatach, które zostały zastosowane wobec Polski i Węgier, w konsekwencji uruchomienia procedury art. 7 TUE. Komisja Europejska uruchomiła procedurę art. 7 wobec Polski w grudniu 2017 roku, natomiast wobec Węgier we wrześniu 2018. Data uruchomienia tej procedury wobec Polski została uznana za datę graniczną z uwagi na bezprecedensową sytuację w Unii Europejskiej. Zamykającą rozważania klamrą będzie maj 2024 roku, kiedy procedura wobec Polski została zakończona. W pracy została podjęta próba weryfikacji hipotezy zakładającej, że UE czuwa nad przestrzeganiem wspólnych wartości, w tym respektowaniem zasady praworządności w państwach członkowskich. Praca mierzy się z odpowiedzią na pytanie czy na ochronę praworządności główny wpływ ma skuteczność unijnych mechanizmów czy też sama wewnątrzsystemowa zmiana zachodząca w państwie członkowskim?

The aim of the paper is to present the tools and procedural mechanisms of the European Union used to protect the fundamental values embodied in the Treaties, which were applied to Poland and Hungary as a consequence of the triggering of the Article 7 procedure of the TEU. The European Commission launched the Article 7 procedure against Poland in December 2017 and against Hungary in September 2018. The date of launching this procedure against Poland was considered a border date due to the unprecedented situation in the European Union. The closing consideration will be May 2024, when the procedure against Poland was terminated. The work attempts to verify the hypothesis assuming that the EU ensures the observance of common values, including respect for the rule of law in the Member States. The work aims to answer the question whether the protection of the rule of law is mainly influenced by the effectiveness of EU mechanisms or by the intra-systemic change taking place in a Member State?
