Praca stanowi analizę prawnoporównawczą instytucji kredytu małżeńskiego w dwóch państwach totalitarnych: niemieckiego Ehestandsdarlehen (ustawa z 1 czerwca 1933 r.) oraz włoskiego Prestito Matrimoniale (dekret z 21 sierpnia 1937 r.). Obie instytucje, formalnie będące wsparciem ekonomicznym młodych małżeństw, stanowiły w istocie instrumenty polityki ludnościowej łączące prawo rodzinne, finansowe i społeczne z celami ideologicznymi reżimu. Celem pracy jest wykazanie, że mimo zbliżonej formy prawnej i wspólnej funkcji pronatalistycznej obie instytucje opierały się na odmiennych założeniach aksjologicznych. W III Rzeszy kredyt małżeński był od początku narzędziem selekcji biologiczno-rasowej, ściśle powiązanym z ustawodawstwem eugenicznym; we Włoszech miał charakter przede wszystkim demograficzny i ekonomiczny. Praca dowodzi, że pomimo wspomnianych różnic konstrukcja obu instytucji prowadziła do istotnego ograniczenia autonomii rodziny i naruszenia zasady równości.
Abstrakt (EN)
The thesis presents a comparative legal analysis of the institution of the marriage loan in two totalitarian states: the German Ehestandsdarlehen (established by the Act of 1 June 1933) and the Italian prestito matrimoniale (established by the decree of 21 August 1937). Formally constituting economic support for young married couples, both institutions were in fact instruments of population policy that combined family, financial and social law with the ideological aims of the regime.
The aim of the thesis is to demonstrate that, despite their similar legal form and shared pronatalist function, the two institutions rested on different axiological foundations. In the Third Reich the marriage loan was from the outset a tool of biological and racial selection, closely tied to eugenic legislation; in Italy it was primarily demographic and economic in character. The thesis argues that, notwithstanding these differences, the design of both institutions led to a significant restriction of family autonomy and a violation of the principle of equality.
