Zawody obsługujące rynek nieruchomości

Praca magisterska podejmuje problematykę przepisów prawnych ustawy z dnia 21 sierpnia 1997 r. o gospodarce nieruchomościami dotyczących zawodów obsługujących rynek nieruchomości, czyli zawodu rzeczoznawcy majątkowego, pośrednika w obrocie nieruchomościami oraz zarządcy nieruchomości. Na przestrzeni lat regulacje zawodów wskazanych w ustawie o gospodarce nieruchomościami w wyniku nowelizacji ulegały modyfikacjom w różnym stopniu. Niniejsza praca przedstawia obecny stan prawny oraz proces ewolucji tych zmian wraz z ich zamierzonymi i rzeczywistymi skutkami dla rynku nieruchomości. Rozważania szczególną uwagę skupiają na ustawie deregulacyjnej, która przyniosła najdalej idące i znaczące konsekwencje. Problem regulacji omawianych zawodów jest ciągle żywy w przestrzeni publicznej, więc kwestia dalszych zmian w tym zakresie jest sprawą otwartą i może podlegać ocenie. Przeprowadzona przeze mnie obserwacja przedstawia rynek nieruchomości jako obszar działania przedstawicieli wymienionych profesji, którego mechanizmy mają istotne znaczenie dla całej gospodarki państwowej. W odniesieniu do każdego z zawodów, praca ukazuje głównie podstawy normatywne funkcjonowania poszczególnych zawodów, historię zmian w wymaganiach, które pozwalają kandydatom na ubieganie się o wykonywanie zawodu przez przedstawiciela określonej profesji, zakres ich czynności i uprawnień oraz inne aspekty związane z wykonywaniem zawodu na przestrzeni lat. Na podstawie analizy i oceny ewolucji przepisów w tym zakresie sformułowano wnioski i wskazano zwięźle rekomendacje, które mogłyby pomóc w stworzeniu optymalnego systemu regulacji zawodów obsługujących rynek nieruchomości.

The master's thesis addresses the issue of legal provisions of the Act of 21 August 1997 on real estate management concerning professions serving the real estate market, i.e. the profession of property appraiser, real estate agent and property manager. Over the years, the regulations of the professions indicated in the Act on Real Estate Management have been modified to varying degrees as a result of amendments. This work presents the current legal status and the process of evolution of these changes together with their intended and actual effects on the real estate market. The considerations focus on the deregulation act, which brought the most far-reaching and significant consequences. The problem of regulating the discussed professions is still alive in the public space, so the issue of further changes in this area is an open matter and may be subject to assessment. The observation I have conducted presents the real estate market as an area of ​​activity of representatives of the above professions, the mechanisms of which are of significant importance for the entire state economy. In relation to each profession, the work mainly presents the normative basis for the functioning of individual professions, the history of changes in the requirements that allow candidates to apply for the practice of the profession as a representative of a specific profession, the scope of their activities and rights, and other aspects related to the practice of the profession over the years. Based on the analysis and assessment of the evolution of regulations in this area, conclusions were formulated and recommendations were briefly indicated that could help create an optimal system of regulation of professions serving the real estate market.
