Przedmiotem mojej pracy jest pozwolenie na budowę domu jako przejaw funkcji reglamentacyjnej administracji, która ma na celu wyjaśnienie instytucji pozwolenia na budowę, jakie warunki trzeba spełnić, aby móc wnioskować o wydanie decyzji oraz czym jest reglamentacja. Na początku należy wskazać, że warunkiem koniecznym do wystąpienia o pozwolenie na budowę jest to, że zainteresowany musi dysponować nieruchomością na cele budowlane. Kolejnym krokiem jaki należy podjąć jest sprawdzenie czy grunt znajduje na obszarze objętym miejscowym planem zagospodarowania przestrzennego, jeżeli takiego nie ma to trzeba wystąpić o wydanie decyzji o warunkach zabudowy do wójta, burmistrza bądź prezydenta miasta. Przy składaniu wniosku o wydanie pozwolenia należy dołączyć gotowy projekt domu, zgodny z planem miejscowym bądź decyzją. Po spełnieniu warunków pozwolenie na budowę wydaje starosta lub prezydent miasta funkcjonującego na prawach powiatu a organem odwoławczym jest wojewoda.

The subject of my work is a building permit for a house as a regulatory function of the administration, which aims to explain the institution of the permit, what conditions must be met to apply for a decision and what rationing is. At the beginning, it should be stated that a necessary condition for applying for a permit is that the interested person must have the property for construction purposes. The next step that should be taken is to check whether the land is located in the area covered by the local spatial development plan. If there is no such plan, you need to apply for a decision on development conditions to the commune head, mayor or city president. When submitting an application, you must attach a ready-made house design in accordance with the local plan or decision. After meeting these conditions, a building permit is issued by the mayor or the president of a city operating on the principles of a poviat, and the appeal body is the voivode.
