Przestępstwo szpiegostwa w polskim prawie karnym

Abstrakt (PL)

Niniejsza praca poświęcona jest problematyce przestępstwa szpiegostwa uregulowanego w art. 130 Kodeksu karnego. Celem pracy jest analiza najważniejszych elementów konstrukcji tego przestępstwa, ze szczególnym uwzględnieniem strony przedmiotowej, przedmiotu ochrony oraz podmiotu i strony podmiotowej czynu zabronionego. Przedstawione zostało pojęcie szpiegostwa oraz jego charakterystyka na gruncie polskiego prawa karnego. Omówiono czynności sprawcze oraz znamiona strony przedmiotowej przestępstwa, uwzględniając poszczególne typy i postaci czynu zabronionego przewidziane w art. 130 Kodeksu karnego. Przedstawiono również problematykę szpiegostwa w cyberprzestrzeni jako jednego ze współczesnych zagrożeń dla bezpieczeństwa państwa. W pracy omówiono przedmiot ochrony przestępstwa szpiegostwa. Szczególną uwagę poświęcono bezpieczeństwu państwa jako podstawowemu dobru chronionemu przez przepisy prawa karnego. Przedstawiono znaczenie takich wartości jak niepodległość, suwerenność oraz obronność państwa, a także innych dóbr pozostających pod ochroną art. 130 Kodeksu karnego. Dokonano również oceny zakresu penalizacji przestępstwa szpiegostwa po nowelizacji przepisów z 2023 r. Zaprezentowane zostały zagadnienia dotyczące podmiotu i strony podmiotowej przestępstwa szpiegostwa. Wskazano, kto może być sprawcą tego czynu zabronionego, omówiono różnice pomiędzy podmiotem powszechnym a kwalifikowanym oraz przedstawiono wymagania dotyczące strony podmiotowej. Przeanalizowano najważniejsze problemy interpretacyjne pojawiające się na tle stosowania przepisów regulujących odpowiedzialność za szpiegostwo, ze szczególnym uwzględnieniem wątpliwości związanych z nowelizacją z 2023r.

Abstrakt (EN)

This paper is devoted to the issue of the crime of espionage as defined in Article 130 of the Criminal Code. The aim of this paper is to analyze the most important elements of the legal definition of this crime, with particular emphasis on the objective aspect, the object of protection, and the subject and subjective aspect of the prohibited act. The concept of espionage and its characteristics under Polish criminal law are presented. The acts constituting the offense and the objective elements of the crime are discussed, taking into account the various types and forms of the prohibited act provided for in Article 130 of the Criminal Code. The issue of espionage in cyberspace is also addressed as one of the contemporary threats to national security. The paper discusses the object of protection in the crime of espionage. Particular attention is devoted to national security as a fundamental interest protected by criminal law. The importance of values such as independence, sovereignty, and national defense is highlighted, as well as other interests protected under Article 130 of the Criminal Code. An assessment is also made of the scope of criminalization of the crime of espionage following the 2023 amendment to the relevant provisions. Issues concerning the subject and the subjective element of the crime of espionage are presented. The paper identified who may be the perpetrator of this prohibited act, discussed the differences between a general and a qualified perpetrator, and outlined the requirements regarding the subjective element. It analyzed the most significant interpretive issues arising from the application of provisions governing liability for espionage, with particular emphasis on doubts related to the 2023 amendment.
