Należą do nich kolejno: w sferze państwa nowoczesnego zasada tolerancji religijnej, zasada wolności sumienia i wyznania, zasada neutralności państwa, zasada rozdziału państwa i kościoła, źródła legitymacji państwa oraz podstawy praktyk politycznych w demokracji.

The aim of the study is to provide a new image of the dispute between liberals and communitarians which I have designed using religion as a category organizing the polemic. Discussions regarding the contemporary relevance of religion for a democratic state are the perspective from which I examine the dispute. They are concentrated mainly around issues that could be structured as the religious or nonreligious grounds of a constitutional state; and the conditions and forms of an appearance of religion in a democratic public sphere. The constant presence of these discussions and return reemergence of the arguments, lead to the conclusion that religion plays an ambiguous role in a political democratic system. In the paper I investigate to what extent the argumentation strategies occurring in these discussions can be enhanced by benefiting from the most important dispute in the field of political philosophy which has taken place since the seventies of the twentieth century, that is the dispute between liberals and communitarians. Until now, it concerned mainly the idea of justice in a wellordered society and was recognized in terms of oppositions such as individualism - a community, different visions of the subject, the possibility of individuals to revise their way of life and limitation of such a possibility. In contrast to this kind of interpretation I would suggest a recognition of the dispute as one of the principal sources of topics and justifications for reflection on the importance of the role and place of religion in modern liberal democracies. The category of religion used to analyze the dispute allows certain normative assumptions of the modern state and its public sphere to be classified and distinguished. These include on one hand, in the sphere of the modern state, the principle of religious tolerance, the principle of freedom of conscience and religion, the principle of state neutrality, the principle of separation of state and church, the sources of legitimacy of the state and the basic political practices in democratic system. On the other hand, as normative foundations of the modern public sphere, I treat the division between the public sphere and other areas (the state, the private sphere), the conditions for participation of religious doctrines in public debate, as well as a civil religion as a set of normative assumptions, and convictions about the voluntariness of religious associations in a democracy. The conclusion of the research is to identify a new image of the dispute, as well as the theoretical basis of ambiguity in determining the value of religion for the democratic state of law. The work also examines the wider context of the issue associated with the conditions of the public presence of religion appearing in discussions on its relevance to the modern state and its public sphere.
