Bohater fikcyjny jako przedmiot ochrony prawnoautorskiej

Założeniem pracy jest kompleksowe omówienie idei bohatera fikcyjnego przez pryzmat spełnienia przez niego prawnoautorskich przesłanek uznania za utwór w oparciu o dotychczasowy dorobek zarówno polskiej, jak i zagranicznej doktryny oraz judykatury. W pracy wyróżniono elementy składowe postaci fikcyjnej, w tym jego nazwę oraz charakterystykę, oceniając powyższe w świetle przesłanek indywidualności, twórczości oraz ustalenia. Przedstawiono również dychotomiczną koncepcję ochrony bohatera, tj. w ramach utworu macierzystego, jak również jako utwór samodzielny, pozostający w częściowym oderwaniu od utworu macierzystego. Podkreślono ponadto wysoki stopień teoretyczności powyższego modelu ochrony oraz problemy interpretacyjne, jakie niesie ze sobą niniejsza koncepcja, zarówno w analizie samych przesłanek, jak i w orzekaniu sądów.

The assumption of the work is a comprehensive discussion of the idea of ​​a fictional character through the prism of his fulfillment of the copyright requirements for recognition as a work, based on the current achievements of both Polish and foreign doctrine and jurisprudence. The work distinguishes the components of a fictional character, including its name and characteristics, assessing the above in the light of the premises of individuality, creativity and determination. A dichotomous concept of protecting the character is also presented, i.e. as part of the whole work as well as an independent work, partially separated from the work from which the character is originated. Moreover, the high degree of theoretical nature of the above protection model and the interpretation problems that this concept raises, both in the analysis of the premises themselves and in court rulings, were also emphasized.
