OCHRONA WIĘZI RODZINNEJ W ZWIĄZKU Z WPROWADZENIEM ART.446 2 KODEKSU CYWILNEGO

Praca opisuje problematykę ochrony więzi rodzinnej w związku z wprowadzeniem art. 446[2] Kodeksu cywilnego. W pracy przedstawiono ewolucję mechanizmu ochrony więzi rodzinnej i kompensacji krzywdy w razie jej naruszenia w wyniku ciężkiego i trwałego uszkodzenia ciała lub wywołania rozstroju zdrowia członka rodziny. Omówiono argumenty stojące za wprowadzeniem do Kodeksu cywilnego art. 446[2] i podjęto próbę analizy tego przepisu. Przedstawiono również stosowanie nowego instrumentu ochrony więzi rodzinnej poprzez omówienie orzecznictwa zbudowanego na bazie tego artykułu.

This paper examines the issue of protection of family bond as a result of introducing Article 446[2] to the Polish Civil Code. Paper outlines the evolution of the mechanism for protecting family bond and providing compensation for the wrong suffered in the event of an infringement resulting from serious and permanent bodily injury or the causing health disturbance to a family member. The arguments in favour of introducing Article 446[2] into the Polish Civil Code were examined and an attempt was made to analyse this provision. The application of this new measure for the protection of family bond was also presented through a review of the jurisprudence based on this article.
