KOZZD Gostynin - lekarstwo czy trucizna polskiego prawa karnego?

Praca analizuje funkcjonowanie Krajowego Ośrodka Zapobiegania Zachowaniom Dyssocjalnym w Gostyninie jako kontrowersyjnego elementu polskiego systemu prawnego. Badam w niej genezę ośrodka, łącząc go z potrzebą izolacji niebezpiecznych sprawców po amnestii z 1989 roku i zniesieniu kary śmierci. W tekście opisałam drogę sądową prowadzącą do umieszczenia w placówce oraz rygory pobytu, w tym stosowanie przymusu bezpośredniego. I examine the functioning of the National Center for the Prevention of Dissocial Behavior in Gostynin as a controversial element of the Polish legal system. In this study, I trace the center’s origins, linking it to the need to isolate dangerous offenders following the 1989 amnesty and the abolition of the death penalty. In the text, I describe the judicial process leading to placement in the facility and the rigors of detention, including the use of direct coercion. The central focus of the discussion is the numerous constitutional and ethical controversies. I discuss in detail the problem of overcrowding, critical reports by the Ombudsman and international organizations, and analyze the Constitutional Tribunal’s ruling on the legality of the facility. The entire study focuses on the dilemma of whether indefinite post-penal isolation is an effective means of protecting society or a “poison” that violates fundamental civil rights and freedoms in order to cover the “gap” in criminal law.
