Sposoby przeciwdziałania nadużywaniu zarzutu potrącenia w postępowaniu cywilnym

Praca ma na celu prześledzenie ewolucji rozwiązań regulujących możliwość zgłaszania zarzutu potrącenia w procesie cywilnym oraz ocenę skuteczności wprowadzonych i postulowanych w tym zakresie konstrukcji. Po przedstawieniu instytucji kompensacji na gruncie materialnoprawnym, przybliżono koncepcje związane z procesowym zarzutem potrącenia oraz przestawiono stan prawny obowiązujący przed 2019 rokiem. Następnie omówiono w kolejności chronologicznej zmiany w kodeksie postępowania cywilnego i ich oceny, a także przeanalizowano przygotowywany właśnie projekt dalszych modyfikacji instytucji potrącenia na gruncie procesowym, kończąc pracę własną opinią na temat optymalnego kształtu rozwiązań.

The goal of the paper is to describe the evolution of solutions regulating the possibility of using set-off in polish civil court proceedings as well as to assess the effectivity of introduced and proposed solutions in this matter. After explaining the basics of the institution of set-off in the material aspects, the paper goes over the conceptions of procedural set-off and then describes the state of regulations in this matter before 2019. In further parts, the paper analyses the changes in the procedural law in this regard that were already introduced as well as newly proposed solutions which are not yet part of the legal system. The paper finishes with the author's own opinion about the desirable shape of regulations.
