W niniejszej pracy przedstawiono zasadnicze kwestie związane z przeprowadzaniem dowodu z opinii biegłego w procesie cywilnym. Wyjaśniono pojęcie wiadomości specjalnych, które stanowią istotę tego dowodu oraz opisano status prawny biegłego i jego miejsce biegłego w procesie cywilnym. W dalszej części wywodu zaprezentowano ogólne wymagania dotyczące opinii biegłego, zwracając uwagę na określone ustawowo i doktrynalnie elementy opinii, jej formy oraz rodzaje. Zaprezentowano również wybrane zagadnienia na temat dowodu z opinii biegłego w sprawach medycznych.

This master's thesis examines the fundamental issues related to the taking and evaluation of expert evidence in civil proceedings. It explains the concept of specialized knowledge, which constitutes the essence of expert evidence, and discusses the legal status of an expert witness as well as the expert's role in civil litigation. The subsequent part of the thesis presents the general requirements applicable to expert opinions, with particular emphasis on the statutory and doctrinal elements of such opinions, their forms and their types. The thesis also addresses selected issues concerning expert evidence in medical cases.
