Piecza naprzemienna i przesłanki jej orzekania

Tematem niniejszej pracy jest instytucja pieczy naprzemiennej. W pracy omówiono genezę tej instytucji w zagranicznych systemach prawnych oraz w prawie polskim. Przedstawiono także, jak piecza naprzemienna kształtuje się na gruncie współczesnego polskiego systemu prawnego i w jakich aktach prawnych można znaleźć do niej odwołania. Na podstawie regulacji dotyczących pieczy naprzemiennej przeanalizowano, czy dopuszczalne jest orzeczenie pieczy tego modelu w obecnym stanie prawnym oraz przedstawiono postulaty de lege ferenda. Wskazano również i opisano przesłanki, które powinny zostać wzięte pod uwagę przez sąd przy orzekaniu o pieczy naprzemiennej.

The subject of this thesis is the institution of joint physical custody. The thesis discusses the genesis of this institution in foreign legal systems and in Polish law. It also presents how joint physical custody is formed in the contemporary Polish legal system and in which legal acts references to it can be found. On the basis of the regulations on joint physical custody, it was analyzed whether it is permissible to adjudicate this type’s custody in the current legal state and de lege ferenda postulates were presented. It also indicates and describes the premises that should be taken into account by the court when adjudicating on joint physical custody.
