Centralny Bank Państwa a emisja cyfrowych walut banków centralnych

Praca stanowi analizę uregulowań odnoszących się do centralnego banku państwa oraz możliwości emisji cyfrowych walut banków centralnych (CBDC) przez tą instytucję. W jej ramach zostały przedstawione funkcje oraz regulacje prawa unijnego determinujące charakterystykę prawną banków centralnych państw członkowskich Unii Europejskiej. Omówione zostały konstytucyjne i ustawowe normy określające pozycję ustrojową, zadania oraz kompetencje organów Narodowego Banku Polskiego. Ponadto zaprezentowana została ogólna specyfikacja CBDC, w szczególności przyczyny i sposoby ich kreacji, a także zakres podmiotowy ich zastosowania. W ostatniej części pracy wskazane zostały także skutki kreacji CBDC na pozycję ustrojową banku centralnego oraz kompetencje Narodowego Banku Polskiego do potencjalnego rozpoczęcia ich emisji.

The paper provides an analysis of the regulations concerning national central bank and the potential issuance of central bank digital currencies (CBDC) by this institution. It outlines the functions and European Union regulations that determine the legal characteristics of central banks in the member states of the European Union. The constitutional and statutory norms that define the institutional position, tasks, and competencies of the bodies of the National Bank of Poland are discussed. Furthermore, the paper presents a general specification of CBDCs, focusing particularly on the reasons and methods for their creation, as well as the scope of their application. In the final section, the paper also highlights the implications of the issuance of CBDCs on the institutional position of the central bank and the competencies of the National Bank of Poland regarding the potential initiation of their issuance.
