Dezinformacja medyczna w internecie - źródła, charakterystyka, sposoby zwalczania

Celem niniejszej pracy jest zaznajomienie czytelnika z problematyką dezinformacji medycznej w internecie oraz możliwych sposobów uregulowania tego zagadnienia przez prawo w sposób skuteczny i adekwatny. Praca w pierwszej części obejmuje omówienie zjawiska dezinformacji w internecie, w tym jego historię, techniki i środki stosowane przez podmioty rozpowszechniające fałszywe treści a także przyczyny i kontekst społeczno-technologiczny, który stanowi o tym, jak poważny jest to problem. W drugiej części scharakteryzowana została dezinformacja medyczna wraz z omówieniem kluczowych nurtów oraz stworzeniem typologii sprawców i motywacji nimi kierujących. Trzecia część obejmuje rozważania prawne, w tym analizę obecnie funkcjonujących przepisów w prawodawstwie polskim i światowym, opis trudności z jakimi musiałby się zmierzyć prawodawca przy próbie uregulowania tej kwestii a także propozycję rozwiązań. Praca odnosi się zarówno do źródeł naukowych jak i samych treści stanowiących dezinformację medyczną.

This paper aims to familiarize the reader with the issue of medical disinformation online and possible ways to effectively and adequately regulate it through law. The first part of this paper discusses the phenomenon of online disinformation, including its history, the techniques and means used by entities disseminating false content, as well as the causes and socio-technological context that determine the seriousness of this problem. The second part characterizes medical disinformation, discussing key trends and aiming to create a typology of perpetrators and their motivations. The third part includes legal considerations, including an analysis of current regulations in Polish and foreign law, a description of the challenges legislators would face in attempting to regulate this issue, and proposed solutions. The work addresses both scientific sources and the content constituting medical disinformation itself.
