Ochrona praw nabywcy w ramach ustawy z dnia 20 maja 2021 r. o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego oraz Deweloperskim Funduszu Gwarancyjnym

Praca magisterska pod tytułem „Ochrona praw nabywcy w ramach ustawy z dnia 20 maja 2021 r. o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego oraz Deweloperskim Funduszu Gwarancyjnym” stanowi kompleksową ocenę rozwiązań wprowadzonych do polskiego systemu prawnego. Omawiana praca koncentruje się na problematyce optymalizacji ochrony praw nabywcy oraz omówieniu sytuacji prawno-faktycznej, w której znalazł się deweloper. Jednocześnie zwrócono w niej uwagę na różnice legislacyjne wynikające ze zmian pomiędzy ustawą z dnia 16 września 2011 r. o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego, a ustawą z dnia 20 maja 2021 r. o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego oraz Deweloperskim Funduszu Gwarancyjnym. Ze względu na obecnie występującą sytuację na rynku deweloperskim oraz przewagę popytu nad podażą temat ten wydaje się niezwykle interesujący, bowiem uprzywilejowania sytuacja dewelopera może negatywnie wypływać na potencjalnego nabywcę. Praca magisterska została napisana przy uwzględnieniu aktualnego orzecznictwa oraz literatury naukowej z zakresu nauk prawniczych. Niestety ze względu na nowatorskość wprowadzonych zmian brak jest ukształtowanej linii orzeczniczej rozwiązującej nieścisłości wynikające z omawianej ustawy.

The master's thesis titled Protection of purchase rights under the Act of May 20, 2021 on the protection of property rights in a residential or single-family house and the Developer Guarantee Fund is a comprehensive assessment of access to the Polish legal system. The discussed work covers the problematic optimization of the protection of the right to purchase and the discussion of the legal and factual situation that is available to the developer. The decision was made in light of the legislative difference with changes between the Act of September 16, 2011 on the protection of the rights of purchasers of residential or single-family houses, the Act of May 20, 2021 on the protection of the rights of purchasers of residential or single-family houses and the Developer Guarantee Fund. Due to the existing solution in the developer market and the application, over the solution, this topic that arises because it concerns the preference of the developer's solution that may cause violations to occur by the consumer. The master's thesis was described using current case law and scientific literature in the field of legal sciences. Unfortunately, due to the novelty of the introduced changes, there is no established line of jurisprudence solving the inconsistencies regarding the Act in question.
