Przedmiot dowodu w postępowaniu cywilnym

Problematyka dowodów i postępowania dowodowego jest jedną z podstawowych kwestii w postępowaniu sądowym. Zgromadzenie odpowiedniego materiału dowodowego jest niezbędne do wydania sprawiedliwego wyroku. W niniejszej pracy przedstawiono regulacje dotyczące przedmiotu dowodu na gruncie dawnego k.p.c. z 1930 r. oraz obecnego k.p.c. z 1964 r. w oparciu o dzieła autorów odpowiednio międzywojennych i współczesnych. Następnie porównano oba stany prawne.

The issue of evidence and evidentiary proceedings is one of the fundamental aspects of judicial proceedings. Gathering appropriate evidentiary material is essential for issuing a just verdict. This paper presents the regulations concerning the object of proof under the former Polish Code of Civil Procedure (k.p.c.) of 1930 and the current k.p.c. of 1964, based on the works of interwar and contemporary authors, respectively. Subsequently, both legal frameworks are compared.
