Środki przymusu w sprawach o przestępstwo przemocy domowej

Przedmiotem pracy są rozważania dotyczące regulacji środków przymusu procesowego stosowanych w sprawach o przestępstwo znęcania się (art. 207 k.k.) z perspektywy ochrony ofiar przemocy domowej. Analizie poddano instytucję zatrzymania ogólnego i obligatoryjnego z art. 244 § 1b k.p.k., tymczasowego aresztowania z przesłankami z art. 258 k.p.k. - w tym kontrowersyjną przesłankę surowości grożącej kary (która może mieć zastosowanie, gdy pokrzywdzony przestępstwem jest osobą nieporadną ze względu na jej wiek, stan psychiczny lub fizyczny lub gdy podejrzanemu zarzucono stosowanie szczególnego okrucieństwa) oraz wolnościowe środki zapobiegawcze: dozór Policji z zakazami zbliżania się i kontaktowania (art. 275 § 2 k.p.k.), nakaz okresowego opuszczenia lokalu zajmowanego wspólnie z pokrzywdzonym (art. 275a k.p.k.). Dopełnieniem wywodu uczyniono ocenę poręczenia majątkowego oraz zakazu opuszczania kraju. Choć w sprawach o przestępstwa z art. 207 k.k. środki te nie odgrywają roli wiodącej, ich uwzględnienie uzasadnia funkcja subsydiarna w ramach kumulacji instytucji wolnościowych. Ryzyko utraty wartości majątkowych (art. 266 k.p.k.) bywa bodźcem dyscyplinującym sprawcę do przestrzegania zakazów zbliżania się i kontaktowania, z kolei zakaz opuszczania kraju (art. 277 k.p.k.) zabezpiecza proces przed ucieczką oskarżonego za granicę, m.in. w realiach migracji zarobkowej czy w związkach z elementem transgranicznym.

Abstrakt (EN)

The study analyzes the legal regulations governing coercive procedural measures applied in cases involving the offence of domestic abuse (Article 207 of the Polish Penal Code) from the perspective of protecting victims of domestic violence. The scope of the analysis encompasses general and mandatory detention pursuant to Article 244 § 1b of the Code of Criminal Procedure, pre-trial detention based on the grounds specified in Article 258 of the Code of Criminal Procedure - including the controversial ground of the severity of the anticipated penalty (applicable when the victim is a vulnerable person due to age, mental state, or physical condition, or when the suspect is charged with acting with particular cruelty) - as well as non-custodial preventive measures: police supervision combined with restraining and non-contact orders (Article 275 § 2 of the Code of Criminal Procedure) and the temporary eviction order from premises shared with the victim (Article 275a of the Code of Criminal Procedure). The analysis is supplemented by an examination of bail (financial surety) and the prohibition on leaving the country. Although these measures do not play a primary role in proceedings concerning offences under Article 207 of the Polish Penal Code, their inclusion is justified by their subsidiary function within the cumulative application of non-custodial measures. The risk of forfeiting financial assets (Article 266 of the Polish Code of Criminal Procedure) serves as an effective deterrent, compelling the perpetrator to comply with non-molestation and restraining orders, whilst the prohibition on leaving the country (Article 277 of the Polish Code of Criminal Procedure) safeguards the proceedings against the defendant absconding abroad-particularly in the context of economic migration or relationships with a cross-border dimension.
