Zażalenie poziome w postępowaniu cywilnym

Niniejsza praca poświęcona jest zażaleniu poziomemu w postępowaniu cywilnym. Autorka omawia istotę zażalenia w postępowaniu cywilnym. W pracy przedstawiono najważniejsze przyczyny wprowadzenia zażalenia poziomego w postępowaniu cywilnym, jak również rozgraniczono zażalenie poziome od zażalenia klasycznego (dewolutywnego). Analizie zostały poddane poglądy przedstawiane w doktrynie, jak również orzecznictwo Sądu Najwyższego. W dalszej kolejności autorka opisuje również przebieg postępowania zażaleniowego ze szczególnym uwzględnieniem nowelizacji k.p.c. z 2023 roku.

This work is devoted to horizontal complaints in civil proceedings. The author indicates the essence of a complaint in civil proceedings. The paper presents the most important reasons for the introduction of a horizontal complaint in civil proceedings and distinguishes a horizontal complaint from a classic complaint. The views presented in the doctrine as well as the jurisprudence of the Supreme Court were analyzed. Next, the author also presents the course of the appeal procedure, with particular emphasis on the amendment to the Polish Code of Civil Procedure from 2023.
