Autonomia prokuratora w procesie karnym w warunkach hierarchicznej struktury prokuratury

Praca poświęcona jest analizie autonomii prokuratora w procesie karnym w warunkach hierarchicznej struktury prokuratury. Przedmiotem rozważań jest zakres samodzielności prokuratora przy podejmowaniu decyzji procesowych oraz wpływ mechanizmów podporządkowania służbowego, nadzoru i kierownictwa na wykonywanie funkcji prokuratorskiej. Analizie poddano regulacje Kodeku postępowania karnego, ustawy Prawo o prokuraturze oraz Regulaminu wewnętrznego urzędowania powszechnych jednostek organizacyjnych prokuratury. Szczególną uwagę poświęcono poleceniom dotyczącym treści czynności procesowych, nadzorowi służbowemu, ocenie dowodów, kluczowym decyzjom podejmowanym w postępowaniu przygotowawczym oraz wykonywaniu funkcji oskarżyciela publicznego przed sądem. Praca obejmuje również ocenę obowiązujących gwarancji niezależności prokuratora, zagrożeń wynikających z obecnego modelu ustrojowego oraz propozycje jego zmian de lege ferenda.

This thesis examines the autonomy of public prosecutors in criminal proceedings within the hierarchical structure of the prosecution service. It focuses on the scope of prosecutorial autonomy in procedural decision-making and on the impact of mechanisms of hierarchical subordination, supervision, and managerial authority on the exercise of prosecutorial functions. The analysis covers the provisions of the Code of Criminal Procedure, the Act on the Public Prosecution Service, and the Rules of Internal Procedure of the Common Organisational Units of the Public Prosecution Service. Particular attention is given to instructions concerning the substance of procedural acts, official supervision, the assessment of evidence, key decisions made during pre-trial proceedings, and the exercise of the function of a public prosecutor before the court. The thesis also assesses the existing safeguards of prosecutorial independence, the risks arising from the current institutional model of the prosecution service, and proposals for its reform de lege ferenda.
