Kształtowanie systemu ochrony sygnalistów w Polsce - analiza procesów legislacyjnych w latach 2017-2024

Celem pracy jest analiza procesów kształtowania i wdrażania instytucji ochrony sygnalistów w Polsce w latach 2017-2024, ze szczególnym uwzględnieniem kontekstu legislacyjnego, kulturowego i komunikacyjnego. Badanie koncentruje się na pytaniu, jakie czynniki polityczne, instytucjonalne i społeczne wpływały na ostateczny kształt ustawy o ochronie sygnalistów oraz jakie tematy dominowały w debacie poświęconej kształtowaniu regulacji. W ujęciu teoretycznym praca odwołuje się do koncepcji społeczeństwa informacyjnego, w którym informacja staje się podstawowym zasobem, a whistleblowing – formą obywatelskiej partycypacji i społecznej kontroli. Praca składa się z trzech głównych części. W pierwszej omówiono dorobek teoretyczny dotyczący korupcji, prawa pracy i roli sygnalistów. Druga część przedstawia założenia metodologiczne, w tym pytania badawcze oraz etyczne wyzwania. Trzecia część obejmuje analizę przebiegu procesu legislacyjnego, ukazanego w czterech fazach. Szczególną uwagę poświęcono analizie debat komisji senackiej, w ramach której wypracowano ostateczny kształt ustawy. Omówiono kluczowy spór o katalog naruszeń objętych ochroną oraz sposoby definiowania roli sygnalisty przez różne grupy interesariuszy. W świetle teorii społeczeństwa informacyjnego whistleblowing jawi się jako kluczowy element nowoczesnego zarządzania informacją i ryzykiem. Istotnym wątkiem analizy jest także refleksja nad postępującą prywatyzacją wymiaru sprawiedliwości, rozumianą jako przenoszenie odpowiedzialności za wykrywanie i rozliczanie naruszeń wewnątrz organizacji. Wnioski pracy podkreślają konieczność monitorowania skuteczności ustawy oraz rozwijania kultury organizacyjnej opartej na transparentności i zaufaniu. Ostatecznie, w erze cyfrowej to nie brak informacji, lecz brak zaufania w jej obiegu stanowi największe wyzwanie dla skutecznej ochrony sygnalistów.

The aim of this study is to analyse the process of shaping and implementing whistleblower-protection institutions in Poland between 2017 and 2024, with particular emphasis on their legislative, cultural and communicative context. The study examines the political, institutional and social factors that influenced the final form of the whistleblower protection act, as well as the key themes that dominated the debate accompanying its development. Theoretically, the thesis draws on the concept of the information society, in which information becomes a fundamental resource and whistleblowing is understood as a form of civic participation and social accountability. The thesis consists of three main parts. The first part discusses theoretical approaches to corruption, labour law and the role of whistleblowers. The second part outlines the methodological framework, including the research questions and ethical challenges. The third part analyses the legislative process, presented in four phases, with particular attention paid to the debates of the Senate committees, where the final provisions of the bill were negotiated. This section examines, among other issues, the key dispute over the catalogue of violations covered by protection and the ways in which different stakeholder groups conceptualised the role of the whistleblower. Within the framework of information society theory, whistleblowing emerges as a crucial mechanism of contemporary information and risk governance. An additional dimension of the analysis concerns the ongoing privatisation of justice, understood as the transfer of responsibility for detecting and addressing organisational misconduct to internal reporting structures. The study concludes by emphasising the need to monitor the effectiveness of the new legislation and to foster an organisational culture grounded in transparency and trust. Ultimately, in the digital age, it is not the scarcity of information but the erosion of trust in its circulation that poses the greatest challenge to effective whistleblower protection.
