Przesłuchanie podejrzanego w postępowaniu karnym

W niniejszej pracy zostały omówione różne metody przesłuchania podejrzanego w postępowaniu karnym. Autorka szczegółowo omówiła wywodzącą się ze Stanów Zjednoczonych technikę Reida, która jest najczęściej wybieraną i stosowaną przez służby metodą przesłuchania podejrzanego. Technika Reida od lat budzi wiele kontrowersji i wątpliwości ze względu na liczne zgłaszane przypadki nadużyć. Źródłem krytyki techniki Reida stało się częste stosowanie tortur, przymusu, groźby i innego poniżającego bądź nieludzkiego traktowania. Odpowiedzią na technikę Reida było opublikowanie przez ONZ w maju 2021 roku wytycznych dotyczących sposobu przeprowadzania przesłuchania pt. „Principles on Effective Interviewing for Investigations and Information Gathering”, znanych powszechnie jako Zasady Méndeza. W dalszej części pracy autorka szczegółowo opracowała i omówiła dokument ONZ, w którym promuje się przesłuchanie oparte na relacji, dialogu, wzajemnym szacunku oraz gwarantuje się ochronę praw człowieka. Ponadto w pracy zostały szeroko omówione inne znane w polskim procesie karnym metody przesłuchania podejrzanego. Praca kończy się podsumowaniem, w którym autorka przedstawił swoje wnioski i rozważania.

This master thesis discusses various methods of interrogating a suspect in criminal proceedings. The author discusses in detail the Reid technique, which originated in the United States and is the most frequently chosen and used method by the services to interrogate a suspect. The Reid technique has been the subject of much controversy and doubt over the years due to numerous reported cases of abuse. A source of criticism of the Reid technique has been its frequent use of torture, coercion, threats and other degrading or inhumane treatment. The response to the Reid technique was the publication by the UN in May 2021 of guidelines on how to conduct an interrogation, entitled Principles on Effective Interviewing. Principles on Effective Interviewing for Investigations and Information Gathering, commonly known as the Méndez Principles. The author further elaborated and discussed in detail the UN document, which promotes interrogation based on rapport, dialogue, mutual respect and guarantees the protection of human rights. In addition, the work extensively discusses other methods of interrogating a suspect known in the Polish criminal process. The paper ends with a summary, in which the author presented her conclusions and considerations.
