UMOWA O PRACĘ NA OKRES PRÓBNY

Niniejsza praca podejmuje tematykę umowy o pracę na okres próbny, która stanowi jedną z podstawowych form zatrudnienia w polskim prawie pracy. Na początku przedstawiono definicję umowy o pracę, najważniejsze jej rodzaje, aby ukazać kontekst, w którym funkcjonuje umowa na okres próbny. Następnie omówiono cechy charakterystyczne owej umowy, takie jak limit czasowy, formę oraz sposób jej zawarcia. Szczególną uwagę poświęcono na analizę korzyści dla pracodawcy oraz pracownika, płynących z zastosowania umowy na okres próbny oraz potencjalnym zagrożeniom, wynikającym z nadużycia tej formy zatrudnienia. W ostatnim rozdziale skupiono uwagę na sposobach zakończenia umowy na okres próbny, poprzez wypowiedzenie, porozumienie stron, a także jej wygaśnięcie. W omawianej pracy dokonano próbę oceny, czy aktualne przepisy dotyczące umowy o pracę na okres próbny są zgodne z potrzebami rynku pracy oraz czy zapewniają odpowiednią równowagę interesów obu stron zatrudnienia.

This paper deals with the issue of a trial period employment contract, which is one of the basic forms of employment in Polish labor law. At the beginning, the definition of an employment contract and its most important types are presented, in order to show the context in which a trial period contract operates. Then, the characteristic features of this contract are discussed, such as the time limit, form and method of its conclusion. Particular attention is paid to the analysis of the benefits for the employer and the employee resulting from the use of a trial period contract and the potential threats resulting from the abuse of this form of employment. The last chapter focuses on the ways of ending a trial period contract, through notice, agreement of the parties, and its expiry. The paper attempts to assess whether the current regulations concerning a trial period employment contract are consistent with the needs of the labor market and whether they provide an appropriate balance of interests of both parties to employment.
