System wspierania i resocjalizacji nieletnich-analiza dogmatyczna i ewolucyjna

Praca skupia się wokół zagadnienia popełniania czynów karalnych oraz wykazywania przejawów demoralizacji przez nieletnich. Przedstawione zostają rozwiązania ustawy o wspieraniu i resocjalizacji nieletnich, jak również obowiązującej poprzednio ustawy o postępowaniu w sprawach nieletnich. Wskazane zostają różnice oraz podobieństwa pomiędzy dwoma systemami, a także przyczyny uchwalenia nowej ustawy. Na koniec przybliżona zostaje problematyka resocjalizacji, jej skuteczności, wyzwań z którymi jest związana, a także skuteczności rozwiązań przewidzianych w ustawie.

This thesis focuses on the issue of juveniles committing punishable acts and exhibiting signs of demoralization. It presents the solutions adopted in the Act on the Support and Rehabilitation of Juveniles, as well as those contained in the previously binding Act on Proceedings in Juvenile Cases. The similarities and differences between the two legal frameworks are identified and analyzed, together with the reasons for the enactment of the new legislation. Finally, the thesis discusses the issue of rehabilitation, its effectiveness, the challenges associated with it, and the effectiveness of the measures provided for in the Act.
