Wpływ rozporządzenia DORA na ramy prawne outsourcingu usług ICT w sektorze bankowym

Przedmiotem niniejszej pracy jest analiza wpływu rozporządzenia DORA na kształt ram prawnych outsourcingu usług ICT w sektorze bankowym. W tym celu przeanalizowano poruszające tematykę outsourcingu przepisy ustawy Prawo bankowe i wybrane akty prawa miękkiego a następnie scharakteryzowano rozporządzenie DORA ze szczególnym uwzględnieniem regulacji dotyczących zarządzania ryzykiem ze strony zewnętrznych dostawców usług ICT. Przepisy rozporządzenia porównano z omówionymi regulacjami, ukazując podobieństwa i różnice tych aktów, zwłaszcza w zakresie obowiązków nakładanych na banki. Zestawiono także przepisy nadzorcze dotyczące przestrzegania przez banki regulacji outsourcingu usług ICT. W pracy posłużono się metodą dogmatyczno-prawną oraz porównawczo-prawną.

The thesis examines the impact of the DORA Regulation on the legal framework governing the outsourcing of ICT services in the banking sector. To this end, the provisions of the Polish Banking Law Act and selected soft law instruments addressing outsourcing were analysed, followed by a characterization of the DORA Regulation, with particular emphasis on the principles for a sound management of ICT third-party risk. The provisions of the Regulation were then compared with the aforementioned legal instruments in order to identify their similarities and differences, especially with regard to the obligations imposed on banks. The thesis also reviews the supervisory regulations concerning banks’ compliance with the legal framework applicable to the outsourcing of ICT services. The research is based on the dogmatic-legal method and the comparative-legal method.
