System bezpieczeństwa lotnictwa cywilnego w Unii Europejskiej – rola i inicjatywy EASA i EUROCONTROL w przeciwdziałaniu zagrożeniom dla transportu lotniczego

Niniejsza praca podejmuje temat systemu bezpieczeństwa lotniczego w Unii Europejskiej, kreowanego przez organizacje EASA oraz EUROCONTROL. Organizacje te stanowią filary polityki bezpieczeństwa lotnictwa cywilnego w UE i są naczelnymi instytucjami tworzącymi normy i standardy w tym zakresie. W celu zdefiniowania roli organizacji, scharakteryzowano podstawy prawne ich funkcjonowania oraz organy wewnętrzne omawianych podmiotów. Analizie poddano także mechanizmy wypracowane w ramach organizacji, stosowane zarówno w sytuacjach kryzysowych, jak i w codziennej działalności europejskiego lotnictwa. W pracy zwrócono uwagę na rolę współpracy UE, EASA i EUROCONTROL, opartej na komplementarności kompetencji, będącej kluczowym elementem europejskiego systemu bezpieczeństwa lotniczego. Aby empirycznie potwierdzić założenia o istocie współpracy i skuteczności mechanizmów odwołano się do przykładu lotu FR 4978, obrazującego reakcję organizacji wobec zagrożenia dla lotu cywilnego.

This thesis addresses the aviation safety system in European Union, shaped by EASA and EUROCONTROL. These organizations constitute the pillars of the EU’s civil aviation safety policy and serve as the principal institutions responsible for establishing regulations and standards in this field. In order to define their role, the legal foundations of their operation, as well as the internal bodies of the organizations are examined. The study also analyses the mechanisms developed within these organizations, which are applied both in crisis situations and in the routine aviation activities. Special attention is devoted to cooperative relationship between the EU, EASA and EUROCONTROL, based on the complementarity of their mandates and competencies, which constitutes a key element of the European aviation safety system. To substantiate this argument and evaluate the effectiveness of the mechanisms employed by these institutions, the study examines the case of Flight FR 4978, illustrating the response of these organizations to a threat to civil aviation.
