Prawo pierwokupu nieruchomości rolnej przysługujące Krajowemu Ośrodkowi Wsparcia Rolnictwa

Celem niniejszej pracy magisterskiej jest analiza instytucji prawa pierwokupu nieruchomości rolnych w Polsce, ze szczególnym uwzględnieniem roli, jaką w tym procesie odgrywa Krajowy Ośrodek Wsparcia Rolnictwa. W pierwszej części pracy przedstawiono informacje dotyczące instytucji prawa pierwokupu oraz definicji nieruchomości rolnej w polskim porządku prawnym, a także omówiono sposób powstania Krajowego Ośrodka Wsparcia Rolnictwa. Druga część pracy koncentruje się na szczegółowej analizie konstrukcji prawnej prawa pierwokupu nieruchomości rolnej, która została rozszerzona o omówienie wybranych przypadków praktycznych w orzecznictwie Sądu Najwyższego. Dodatkowo, dokonano porównania obrotu nieruchomościami rolnymi w wybranych państwach członkowskich Unii Europejskiej, co pozwoliło na ukazanie różnic i podobieństw w podejściu do tego zagadnienia w różnych krajach. Na koniec pracy omówiono skutki wykonania prawa pierwokupu przez Krajowy Ośrodek Wsparcia Rolnictwa oraz dokonano oceny konstrukcji i działania tej instytucji w praktyce. Celem pracy jest również wyciągnięcie wniosków dotyczących efektywności prawa pierwokupu nieruchomości rolnych w Polsce i zaproponowanie usprawnień w jego stosowaniu.

The aim of this master's thesis is to analyze the institution of the right of first refusal for agricultural properties in Poland, with particular emphasis on the role played by the National Support Centre for Agriculture in this process. The first part of the thesis presents information regarding the institution of the right of first refusal and the definition of agricultural property in Polish law, as well as discusses the establishment of the National Support Centre for Agriculture. The second part focuses on a detailed analysis of the legal framework of the right of preemption for agricultural property, which is expanded to include the discussion of selected practical cases in the rulings of the Supreme Court. Additionally, a comparison of agricultural property transactions in selected European Union member states is made, highlighting the differences and similarities in the approach to this issue in various countries. Finally, the thesis discusses the consequences of the exercise of the right of preemption by the National Support Centre for Agriculture and evaluates the construction and functioning of this institution in practice. The aim of the thesis is also to draw conclusions regarding the effectiveness of the right of first refusal for agricultural property in Poland and propose improvements in its application.
