Między normą a uzusem. O roli teorii prawa i doktryny w procesie oceny jakości przekładu prawnego

The article presents the role of legal theory and doctrine in assessing the quality of legal texts and their translations in institutional contexts. The analysis of the logical relations between the norm and the usage in international agreements, EU texts and normative acts shows the multiplicity of norms and usages in the analyzed legislative drafting guidelines, translator’s guidelines or spelling regulations in three domains: language, law and translation. It is possible on this basis to indicate the supremacy of norms of law in assessing the quality of a legal text and its translation due to ‘coherence’ as one of the key principle guiding the assessment of translation quality in law.
