Monitorowanie zachowań użytkowników serwisów społecznościowych na przykładzie Meta Platform - ryzyka i wyzwania - wybrane zagadnienia

W niniejszej pracy przeprowadzono analizę monitorowania zachowań użytkowników przez serwis społecznościowy – Meta. Wyjaśniono zasady działania portala i sposoby wykorzystywania danych użytkowników, które portal pozyskuje, zarówno z działalności użytkowników na portalu, jak również na skutek innej działalności użytkowników w Internecie. Omówiono te zjawiska w ujęciu pozytywnym, jak i negatywnym. Zbadano również aspekty prawne związane z przetwarzaniem danych, monitorowaniem i personalizacją treści, śledzeniem i profilowaniem użytkowników oraz omówiono zagrożenia wynikające z działalności portala, w świetle takich praw człowieka, jak prawo do prywatności i prawo do ochrony danych osobowych. Ponadto, wyjaśniono najważniejsze pojęcia prawne związane z tematyką oraz podjęto próbę zdefiniowania prywatności, prawa do prywatności oraz prawa do ochrony danych osobowych. Następnie, omówiono, w ujęciu historycznym, przepisy, mające za cel ochronę praw podstawowych użytkowników portala oraz zmiany zachodzące w regulacjach, zarówno na poziomie krajowym, jak i międzynarodowym. Omówiono ponadto zakres odpowiedzialności administracyjnoprawnej, cywilnoprawnej i karnej platformy za naruszenia praw podstawowych.

In the thesis, the author has conducted an analysis of monitoring of user behaviour patterns in the social media platform – Meta. The analysis includes the rules of operation of the portal and the way the portal uses data of its users obtained not only from the portal itself but also from other operations and activities of users on the Internet – with the emphasis both on positive and negative aspects of such operations. Moreover, the author examined legal aspects connected with data processing, monitoring and content personalisation, together with surveillance and profiling of portal users. It has also been presented how human rights, such as the right to privacy and the right to protect personal data, are endangered by the portal’s activities. Furthermore, the most significant legal terms connected with the topic have been explained and an attempt to find the appropriate definition of privacy, the right to privacy and the right to protect personal data has also been made. Next, the author has described, in the historical context, legal regulations which aim to provide protection of fundamental rights of the portal users and changes in those regulations, both on the national and international levels. Finally, the author has presented possible administrative, civil and criminal liabilities of the platform for breaches of the above mentioned fundamental rights.
