Wybór sędziów Trybunału Konstytucyjnego

Niniejsza praca przedstawia zagadnienie prawne dotyczące wyboru sędziów Trybunału Konstytucyjnego. Aby do niego bezpośrednio przejść, najpierw potrzebne było omówienie idei leżących na gruncie powstania i istoty samego Trybunału – pojęcia sądownictwa konstytucyjnego i jego historii oraz pojęć kontroli hierarchicznej zgodności norm i powiązanej z nią kontroli konstytucyjności prawa. Następnie przeanalizowana została pozycja ustrojowa, charakterystyka i kompetencje Trybunału Konstytucyjnego. W dalszej części praca bliżej przedstawia sylwetkę sędziego TK – jego skomplikowany i złożony status prawny, podobieństwa oraz odmienności od sędziów innych sądów, a także wymagania, jakie musi spełnić kandydat ubiegający się o taki mandat. Wreszcie, gdy te fundamentalne pojęcia zostały odpowiednio przybliżone, rozważone zostało tytułowe zagadnienie wyboru sędziów TK – w odniesieniu do ram prawnych tego wyboru, jak i jego zasad, trybu czy procedury. Odrębnego spojrzenia wymagała analiza złożenia ślubowania. W pracy postanowiono omówić wydarzenia zarówno z dalszej (2015 r.), jak i tej bliższej (2026 r.) perspektywy czasowej, a które to znacząco są powiązane z zagadnieniem wyboru i ślubowania sędziego TK. Na koniec, praca pokrótce przedstawiła klika ciekawych danych w ujęciu statystycznym w odniesieniu do wyboru sędziów TK na przestrzeni lat 1997-2026.

This Bachelor's thesis presents the legal issue concerning election of judges of the Constitutional Tribunal. First, there are discussed the concepts underlying the creation and essence of the Tribunal itself – the concept of constitutional courts and its history, as well as the concepts of constitutional and hierarchical review. Then, there are analyzed the position and authority of the Constitutional Tribunal. Furthermore, the thesis explores the profile of a Constitutional Tribunal judges – their complex legal status, a comparison with judges of other courts and the requirements a candidate must meet in order to become a Constitutional Tribunal judge. Finally, the titular issue of the election of Constitutional Tribunal judges is considered – in relation to the legal framework of this election, as well as its principles and procedure. Then, there is the analysis of the oath of office of judges. Furthermore, in the thesis there is also briefly described the constitutional crisis surrounding the election of Constitutional Tribunal judges of both 2015 and 2026. Eventually, the thesis presents some interesting statistical data regarding the election of Constitutional Tribunal judges over the years 1997-2026.
