TENDENCJE CENTRALISTYCZNE W DZIAŁANOŚCI SAMORZĄDU TERYTORIALNEGO

Praca omawia problem ingerencji w samodzielność samorządu terytorialnego przez władze centralne poprzez bezpośrednie lub pośrednie zmiany przepisów, wpływające na finanse jednostek samorządu. Ma to istotny wpływ na ideę decentralizacji władzy w Polsce, będącą jedną z fundamentalnych zasad demokratycznego państwa prawa. Opisane zostały zmiany legislacyjne, które wpłynęły na dochody własne samorządu, subwencje ogólne oraz system przyznawania dotacji. Praca porusza także kwestię przestrzegania zasad finansów JST, ze szczególnym uwzględnieniem zasady adekwatności, pomocniczości, stabilności i autonomii finansowej. Szczególną uwagę poświęcono sytuacji gmin, będących podstawowymi jednostkami samorządu terytorialnego. Na podstawie dostępnych badań opisano nieprawidłowości w rozdziale środków publicznych pomiędzy samorządy.

The work discusses the problem of interference in the independence of local government by the central authorities through direct or indirect changes in legislation, affecting the finances of local government units. This has a significant impact on the idea of decentralization of power in Poland, which is one of the fundamental principles of a democratic state of law. Legislative changes that affected local government's own income, general subsidies and the system of granting subsidies are described. The work also addresses the issue of adherence to the principles of local government finances, with particular emphasis on the principles of adequacy, subsidiarity, stability and financial autonomy. Particular attention was paid to the situation of municipalities, which are the basic units of local government. Based on available research, irregularities in the distribution of public funds among local governments are described.
