Test dwustopniowy jako mechanizm zapewnienia „skutecznego środka prawnego” w świetle art. 47 Karty praw podstawowych Unii Europejskiej

Praca magisterska ma na celu wykazanie, czy test dwustopniowy może służyć jako mechanizm zapewnienia skutecznego środka prawnego w rozumieniu art. 47 KPP. W związku z tym, praca podzielona została na cztery rozdziały. Pierwszy z nich dotyczy wyjaśnienia specyfiki zasady praworządności na tle wspólnych i fundamentalnych wartości Unii Europejskiej. Następnie omówiona zostanie kwestia rozumienia „skutecznego środka prawnego oraz prawa do niezawisłego i bezstronnego sądu zarówno w świetle art. 47 KPP, jak i art. 6 i 13 EKPC. Trzeci rozdział skupiać się będzie na analizie testu dwustopniowego, z uwzględnieniem jego genezy, obu jego poziomów oraz charakterze jego stosowania. Ponadto, przedstawiona zostanie kwestia relacji użycia testu w stosunku do zasady wzajemnego zaufania między państwami członkowskimi. Na zakończenie poruszona zostanie problematyka rozszerzania stosowania testu na sprawy z zakresu prawa azylowego oraz ochrony konkurencji na rynku wewnętrznym UE.

The master's thesis aims to demonstrate whether the two-tier test can serve as a mechanism for providing an effective remedy within the meaning of Article 47 of the CFR. Therefore, the work is divided into four chapters. The first one concerns explaining the specificity of the rule of law against the background of the common and fundamental values ​​of the European Union. Next, the issue of understanding an effective remedy and the right to an independent and impartial tribunal in the light of both Article 47 of the CFR and Articles 6 and 13 of the ECHR. The third chapter will focus on the analysis of the two-tier test, including its genesis, the two levels of the test, the nature of its application. In addition, the relationship of the use of the test to the principle of mutual trust between Member States will be presented. It will conclude by addressing the issue of extending the scope of application of the test to asylum law cases and the protection of competition in the EU internal market.
