Ramy prawne cyberbezpieczeństwa w sektorze kosmicznym

W niniejszej pracy dokonano analizy aspektów prawnych cyberbezpieczeństwa w jednym z najbardziej strategicznych i dynamicznie rozwijających się sektorów współczesnej gospodarki – sektorze kosmicznym. W pierwszej kolejności, na podstawie literatury przedmiotu, przedstawiono zagadnienia dotyczące tego sektora, takie jak jego definicja, struktura czy główne wyzwania w kontekście cyberbezpieczeństwa. Następnie omówiono obowiązujące i projektowane regulacje prawne w zakresie cyberbezpieczeństwa mające zastosowanie do analizowanego sektora, w szczególności na poziomie unijnym i krajowym. W tym zakresie przeanalizowano dyrektywę NIS 2, ustawę o Krajowym Systemie Cyberbezpieczeństwa oraz projekt EU Space Act jako kluczowe akty kształtujące ramy prawne w tym obszarze. Ze względu na brak literatury przedmiotu w tym zakresie, analiza regulacji ma charakter samodzielny. W centrum rozważań znalazły się w szczególności zakresy podmiotowe tych regulacji, obowiązki przez nie nakładane, a w wybranych częściach również mechanizmy nadzoru.

This thesis analyses the legal aspects of cybersecurity in one of the most strategic and dynamically developing sectors of the modern economy – the space sector. Firstly, based on the relevant literature, the thesis presents issues related to this sector, including its definition, structure, and the main challenges in the context of cybersecurity. Subsequently, it discusses the existing and proposed cybersecurity regulations applicable to the analysed sector, particularly at the European Union and national levels. In this regard, the thesis examines the NIS 2 Directive, the National Cybersecurity System Act, and the proposed EU Space Act as key legal instruments shaping the regulatory framework in this area. Due to the limited academic literature available on this subject, the analysis of the regulations is primarily original in nature. The thesis focuses in particular on the subjective scope of these regulations, the obligations they impose, and, in selected parts, also on supervisory mechanisms.
