Konkurs na stanowisko dyrektora samorządowej instytucji kultury

Niniejsza praca ma na celu omówienie procedury konkursowej dotyczącej powołania dyrektora samorządowej instytucji kultury. Składa się z pięciu części: wstępu, trzech rozdziałów oraz podsumowania. We wstępie zostaje w zwięzły sposób przedstawiona problematyka pracy. W pierwszym rozdziale zostają omówione pojęcia wstępne dotyczące działalności kulturalnej, państwowej i samorządowej instytucji kultury – ich charakterystyka, zadania, cele, a także aspekt tworzenia, reorganizacji i likwidacji instytucji kultury przy uwzględnieniu pojęć statutu podmiotu oraz rejestru instytucji kultury. Drugi rozdział zawiera omówienie postaci dyrektora instytucji kultury, jego zadań, kompetencji, możliwości jego powołania i odwołania, a także aspekt zwierzchnictwa służbowego. Następnie zostaje zgłębiona procedura konkursowa w oparciu o ustawę z dnia 25 października 1991 r. o organizowaniu i prowadzeniu działalności kulturalnej oraz Rozporządzenie Ministra Kultury i Dziedzictwa Narodowego z dnia 12 kwietnia 2019 r. w sprawie konkursu na kandydata na stanowisko dyrektora instytucji kultury. Ponadto, zostaje również poruszona kwestia osoby pełniącej obowiązki dyrektora, jak również postaci zastępcy dyrektora instytucji kultury, pełnomocnika i zarządcy. W kolejnej części pracy zostają poddane analizie trzy konkursy na kandydata na stanowisko dyrektora samorządowej instytucji kultury. Pierwszym z nich jest konkurs z 2024 roku przeprowadzony w Muzeum Pierwszych Piastów na Lednicy, kolejnym jest konkurs z lat 2021-2022 przeprowadzony w Teatrze Dramatycznym im. Gustawa Holoubka, a ostatnim – konkurs przeprowadzony w tej samej instytucji, ale w 2024 roku. Ostatnia część pracy zawiera podsumowanie rozważań i analiz w niej podjętych.

This thesis aims to discuss the competition procedure for the appointment of a director of a local government cultural institution. It consists of five parts: an introduction, three chapters and a conclusion. In the introduction, the problems of the work are briefly presented. The first chapter discusses the introductory concepts of cultural activity, state and local government cultural institutions - their characteristics, tasks, objectives, as well as the aspect of creation, reorganisation and liquidation of cultural institutions, taking into account the concepts of the entity's statute and the register of cultural institutions. The second chapter discusses the figure of the director of a cultural institution, his tasks, competences, the possibility of his appointment and dismissal, as well as the aspect of official authority. The competition procedure based on the Act of 25 October 1991 on organising and conducting cultural activity and the Regulation of the Minister of Culture and National Heritage of 12 April 2019 on the competition for a candidate for the position of director of a cultural institution is then explored. In addition, the question of the acting director is also addressed, as well as the figures of the deputy director of the cultural institution, the plenipotentiary and the administrator. In the next part of the work, three competitions for a candidate for the position of director of a local government cultural institution are analysed. The first one is the 2024 competition held at the Museum of the First Piasts in Lednica, the next one is the 2021-2022 competition held at the Gustaw Holoubek Drama Theatre, and the last one is the competition held at the same institution, but in 2024. The last part of the work contains a summary of the considerations and analysis undertaken in it.
