ZJAWISKO ,, GOLDPLATINGU W POLSCE NA PRZYKŁADZIE NOWELIZACJI USTAWY O KRAJOWYM SYSTEMIE CYBERBEZPIECZEŃSTWA , IMPLEMENTUJĄCEJ DYREKTYWĘ NIS 2

Niniejsza praca poświęcona jest zagadnieniu goldplatingu w procesie implementacji dyrektyw Unii Europejskiej. W pierwszej kolejności przedstawiona zostanie definicja pojęcia goldplatingu, jego geneza oraz różne podejścia do stosowania tego zjawiska w wybranych państwach członkowskich Unii Europejskiej. W tej części pracy omówiona zostanie również problematyka harmonizacji prawa Unii Europejskiej, a także praktyczne skutki stosowania goldplatingu. W celu wprowadzenia do dalszych rozważań zaprezentowane zostaną początki unijnych regulacji w zakresie cyberbezpieczeństwa - dyrektywa NIS, stanowiąca bezpośredniego poprzednika dyrektywy NIS 2. Przedstawiona zostanie jej geneza, najważniejsze założenia oraz sposób wdrożenia w Polsce w 2018 roku. W dalszej części pracy omówiona zostanie dyrektywa NIS 2, ze szczególnym uwzględnieniem najważniejszych zmian w stosunku do poprzedniej regulacji. Następnie zostanie poddana analizie polska implementacja dyrektywy NIS 2, czyli ustawa o krajowym systemie cyberbezpieczeństwa pod kątem występowania w niej elementów zdefiniowanego wcześniej zjawiska goldplatingu. W ostatniej części pracy podsumowane zostaną wcześniejsze rozważania oraz przedstawione zostaną wnioski de lege ferenda.

This master’s thesis is devoted to the issue of gold-plating in the process of implementing European Union directives. First, the thesis presents the definition of gold-plating, its origins, and different approaches to this phenomenon in selected Member States of the European Union. This part of the thesis also discusses the issue of harmonisation of European Union law, as well as the practical consequences of gold-plating. In order to provide background for further analysis, the thesis then presents the origins of EU cybersecurity regulations, namely the NIS Directive, which was the direct predecessor of the NIS 2 Directive. Its genesis, main assumptions, and the manner of its implementation in Poland in 2018 are discussed. The following part of the thesis focuses on the NIS 2 Directive, with particular emphasis on the most important changes introduced in comparison with the previous regulation. Next, the Polish implementation of the NIS 2 Directive, namely the Act on the National Cybersecurity System, is analysed in terms of the occurrence of elements of the previously defined phenomenon of gold-plating. The final part of the thesis summarises the preceding considerations and presents de lege ferenda conclusions.
