Praca magisterska ma na celu podjęcie próby odnalezienia przyczyny obserwowanej współcześnie dysfunkcjonalności prawa do zwielokrotniania w systemie ochrony praw autorskich i pokrewnych. W opracowaniu przeprowadzono analizę wybranych przełomów technologicznych pod kątem ich wpływu na rozumienie pojęcia zwielokrotniania w prawodawstwie i doktrynie. Pierwsza część poświęcona jest zbadaniu roli i regulacji kopiowania utworów przed narodzinami prawa autorskiego. Druga część analizuje cele prawa do zwielokrotniania we wczesnych ustawach państwowych i redakcjach Konwencji berneńskiej. Trzecia część poddaje analizie wpływ rozwoju technologii analogowych na prawną interpretację zwielokrotnienia. Czwarta część opisuje wpływ technologii masowej reprodukcji na efektywność współczesnego systemu ochrony interesów majątkowych podmiotów uprawnionych.

This Master’s thesis aims to identify the causes of the contemporary dysfunctionality of the right of reproduction within the system of copyright and related rights protection. The study provides an analysis of selected technological breakthroughs regarding their impact on the conceptualization of the term reproduction in both legislation and legal doctrine. The work is structured as follows: The first part is devoted to examining the role and regulation of the copying of works prior to the emergence of modern copyright law. The second part analyzes the objectives of the right of reproduction in early national statutes and subsequent revisions of the Berne Convention. The third part evaluates the influence of the development of analogue technologies on the legal interpretation of reproduction. The fourth part describes the impact of mass reproduction technologies on the effectiveness of the contemporary system for protecting the economic interests of rightholders.
